§1. Third Parties Rights

The client guarantees, with regard to the source materials to be provided by them (master tapes, etc.), that they possess the full required copyright duplication and exploitation rights, particularly those managed by GEMA. For the so-called GEMA registration, the client will provide I LOVE VINYL / Sonderling Rec. with the necessary data and notify I LOVE VINYL / Sonderling Rec. of the use of published and unpublished own and licensed intellectual property rights and applications related to the supplied source materials. In the event that I LOVE VINYL / Sonderling Rec. is held liable by third parties (including GEMA) for alleged infringement of third-party rights (in particular, copyright exploitation and distribution rights), the client will fully indemnify I LOVE VINYL / Sonderling Rec. against such claims and reimburse I LOVE VINYL / Sonderling Rec. for the full costs of legal defense.

§2. Transfer of Audio Media to Analog Media (Vinyl Single Copies)

2.1

Transfers of audio media to analog media (vinyl single copies as backup copies) can only be carried out as direct customer orders. The created media may only be used for private purposes. According to copyright law, the transfer of audio media is generally free of charge. Prices are solely for the use of our equipment, media cleaning, processing, and the material value of blanks and record sleeves. The creation of the backup copy itself is free of charge.

2.2

The created backup copies are exclusively for the private use of the client and may not be sold or distributed through additional digital means. The customer is solely liable for any copyright infringements and indemnifies the contractor against claims for damages by third parties arising from copyright violations.

2.3

We reserve the right to reject orders that violate applicable copyright laws. If a copyright infringement is identified, the order will be declined.
